Terms of use

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only if a parent or guardian has reviewed and agreed to these Terms on your behalf, and that parent or guardian is responsible for your use of it.

You are responsible for the accuracy of the information you give us and for keeping your password secure. You may not create an account on someone else’s behalf, impersonate anyone, or create a new account after we have terminated yours.

We have zero tolerance for objectionable content and abusive users. You may not post, upload, send or share anything that:

• harasses, bullies, threatens, intimidates or abuses anyone;
• is hateful or discriminatory toward any person or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or any other protected characteristic;
• is sexually explicit or pornographic, or sexualises minors in any way;
• depicts or encourages violence, self-harm or dangerous illegal activity, including reckless driving on public roads;
• is spam, a scam, misleading, or deliberately false (including fabricated lap times or results presented as real);
• infringes someone else’s copyright, trademark, privacy or other rights;
• shares another person’s private information without their consent;
• is otherwise illegal, or that we reasonably consider objectionable.

You also may not misuse the Service: no scraping or bulk collection of data, no attempts to access accounts or data that are not yours, no interfering with the Service’s operation, and no automated accounts.

• Report a post, comment, profile, club or track photo in the app: use the … menu on it, or press and hold a comment. Reports go to our moderation team, and you can also reach us at support@mxnkarting.com.
• Block any user from their profile or one of their posts. Blocked users cannot see or interact with your content, and you will not see theirs.
• We review reported content within 24 hours. Content that breaks these Terms is removed, and users who post it are ejected from the Service: their accounts are suspended or terminated.

We do not review everything before it is published. We may review, remove, restrict or disable access to any content that breaks these Terms, or that we reasonably believe creates a safety, legal or community risk, whether or not it was reported, and we may suspend or terminate the accounts responsible. We keep a record of reports and the action taken, and we may cooperate with law enforcement where required.

You own the content you post: your photos, videos, posts, comments, reviews and racing data stay yours. We do not claim ownership of them.

To run the Service we need your permission to use that content, so by posting it you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing and generating previews and thumbnails), display and distribute it, only as needed to operate and improve the Service. In practice that means:

• showing your posts, photos and videos in feeds and clubs;
• showing your profile and activity to the people your settings allow;
• showing your results on leaderboards and in sessions you share, and letting other users share your content within the Service;
• using the service providers listed in our Privacy Policy to store and deliver it.

This licence ends when you delete the content or your account, except for copies already shared by others that they have not deleted, or where we must keep it by law. Photos you contribute to a track’s page and that we approve stay on that page after you delete your account, no longer linked to you; email us if you want one removed.

You are responsible for what you post and confirm you have the rights to it, including permission from anyone identifiable in your photos or videos.

• You are responsible for the accuracy of results you enter by hand or scan from a results sheet.
• When you import results from a track’s timing system, you confirm they are your own results, or that you have permission to import them. Imported data may also be subject to the timing provider’s or venue’s own terms.
• We may correct, hide, remove or exclude from leaderboards any result we reasonably believe is fabricated, mistaken or misleading.
• Leaderboards, points and rankings are for fun. We do not guarantee that they are accurate, complete or always available, and they are not official results.

Motorsport, including karting, is dangerous and can cause serious injury or death. MXN Karting is not a safety device. Never look at or operate your phone, or any app, while driving a kart.

We do not organise, supervise or operate karting. We do not own, run or inspect any track, and we are not responsible for the operation, safety, condition or conduct of any track, venue, event or club listed in the Service. A listing is not an endorsement. The Service is no substitute for a track’s rules, the instructions of marshals and staff, proper safety equipment, or professional instruction; always follow the requirements of the venue and any sanctioning body.

Our times are not official timing. Lap times, positions, speeds and telemetry recorded by your phone or a connected device are estimates derived from GPS and may be inaccurate. They are not official results, and the venue’s timing system is the authority.

You participate in karting at your own risk.

Clubs, events and challenges are organised by users or venues, not by us. We provide the platform only. Their organisers and the venues involved are responsible for safety, scheduling, eligibility and participation, and taking part is a matter between you and them. We are not a party to arrangements between users, and we are not responsible for events that are changed, cancelled or run unsafely.

Track details in the Service, including descriptions, opening hours, layouts, maps, photos, events and weather, come from several sources: our own research, venues, other racers’ suggestions, photos and reviews, GPS measurements, track timing systems, and third parties such as Mapbox, OpenStreetMap contributors, Google and Open-Meteo. Tracks change, and this information may be outdated, incomplete or wrong. Check with the venue before you travel.

Underlying third-party data remains subject to its own licences and terms. Maps are © Mapbox and © OpenStreetMap contributors; some track photos are provided by Google; weather data is by Open-Meteo.com.

We own the Service’s software and design, and our own compilation and presentation of track information, not the third-party data described above. We grant you a personal, non-transferable, revocable licence to use the Service under these Terms.

The Service is free. If we introduce paid features, we will show you their price, renewal, cancellation and refund terms before you buy. We may change, suspend or discontinue any part of the Service at any time.

You can stop using the Service and delete your account at any time (in the app: Profile → Settings → Delete Account). We may suspend or terminate your account, with or without notice, if you break these Terms, if we are required to by law, or if your use creates risk or harm for other users or for us.

When we terminate an account, your right to use the Service ends immediately, and we may remove or hide its content, including posts, results and shared sessions. We may keep records of the violation as described in our Privacy Policy. Sections that by their nature should survive termination (including content licences already exercised, disclaimers, limitation of liability and governing law) survive.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any data in it is accurate.

To the fullest extent permitted by law, MXN Karting and its owners, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, or for any personal injury or property damage arising from karting or motorsport activities, in connection with the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally.

If you downloaded the app from the Apple App Store, the following also applies:

• These Terms are between you and us, not Apple, and we alone are responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store’s Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims, and for investigating and resolving any claim that the app infringes someone’s intellectual property rights.
• You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when using the app, such as your mobile carrier’s.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

We may update these Terms. We will change the date at the top of this page, and for material changes we will notify you in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
